Terms of Service

These terms govern use of this website and the studio work delivered by Mac Digital, a sole proprietorship of Seann MacDougall in Whitby, Ontario, Canada. Catchline subscriptions are governed separately at catchline.ca/terms.
Using this website
The pages here — pricing bands, guides, and comparisons — are published in good faith and kept current, but they are general information, not a quote and not professional advice for your situation. Prices shown are indicative ranges. The figure that binds either of us is the one written in a proposal you have accepted.
Do not use this site to attempt unauthorised access, to scrape it at a volume that degrades it for others, or for any unlawful purpose.
Quotes, scope, and payment
Work begins from a written proposal setting out scope, price, and timeline. Anything outside that scope is a change, quoted separately before it is built — you will not receive a surprise invoice.
Project work is normally invoiced with a deposit before work starts and the balance on delivery, on the terms stated in the proposal. Monthly services are billed in advance and may be cancelled effective at the end of the current billing period. Fees are in Canadian dollars. We will give at least 30 days' notice before changing the price of an ongoing monthly service.
Your part
Delivery depends on things only you can supply: content, photographs, access to domains and hosting, and timely feedback at review points. You confirm you hold the rights to any logo, image, text, or other material you give us to publish. Where a project stalls for want of those, the timeline moves accordingly.
Who owns what
On final payment, you own the website we build for you: the design as delivered, the content written for it, and the domain. It is yours to take elsewhere, and we will not hold a site hostage over a disagreement.
We keep ownership of the underlying tooling, component libraries, and internal systems used to build it, along with anything licensed from a third party under that third party's terms. Unless you ask us not to, we may show the finished work in our portfolio and credit the studio in the site footer.
What we do not promise
We do not promise search rankings, traffic volumes, lead counts, or revenue. Nobody honestly can — Google, the AI engines, and your competitors all move independently of us. What we commit to is the work described in the proposal, done properly, and reported honestly. Where we publish expected outcomes, they are estimates with the reasoning shown, not guarantees.
Websites depend on third-party services — hosting, domain registrars, search engines, payment processors, and analytics providers. We choose them carefully and we do not control them. This website itself is provided on an "as is" and "as available" basis without warranties of any kind, to the extent the law allows.
Liability
To the extent the law allows, our total liability arising from a project is limited to the fees you paid us for that project, and we are not liable for indirect or consequential loss, including lost profits or lost business. Nothing here limits liability that cannot be limited by law.
Ending an engagement
Either of us may end an engagement in writing. You pay for work completed to that point; we hand over what has been paid for. We may suspend or end work for non-payment or for unlawful use.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes go to the courts of Ontario.
Changes
We may update these terms. The version that applies to your project is the one in force when your proposal was accepted.
